MODEL VOLUNTARY COMPREHENSIVE NONSMOKING POLICY FOR BUSINESSES AND ORGANIZATIONS

RESPONSIBILITY:

( Insert Name of company or organization ) employees, students, visitors, clients, customers, are responsible for complying with the following nonsmoking policies.

DEFINITION:

‘Smoke or smoking’ refers to the carrying or smoking of any kind of lighted pipe, cigar, cigarette, or any other lighted smoking product or equipment.

ENCLOSED LOCATIONS:

Buildings
In accordance with California State Law (Labor Code 6404.5) smoking is prohibited in all enclosed buildings, owned or leased by ( company or organization name ).

Motor Vehicles Smoking is prohibited in all motor vehicles, owned or leased by ( company or organization name ).

OUTDOOR LOCATIONS:

Designation
All property owners – individuals and companies - -have a legal right to eliminate smoking entirely on their property (indoors and outdoors) or to limit smoking to designated outdoor areas only.

Outdoor smoking Sample Policy
Outdoor smoking is prohibited within 20 feet of all building openings including doorways, air or ventilation intake systems, entry ways, windows, and 20 feet from any outdoor work area. And/Or Smoking is allowed in designated outdoor areas only.

Disposing of Smoking Refuse
Smoking refuse, such as cigarette butts, burnt tobacco etc. are to be disposed of in ash urns or other containers specifically designated for such disposal. And/Or Smoking refuse is not to be disposed of in trash cans.

Other Requirements
Outdoor locations may also be regulated by fire code, State and local laws, ordinance, or other regulations.

COMPLIANCE:

Visitors, clients or customers will be asked to refrain from smoking and will be respectfully informed of the company's/organization's clean air policy. Any employee or staff member who violates the smoking policy may be subject to disciplinary action by managers or administrators. Please Note: Intentional violation of state or local law regarding smoking may result in a civil fine from local authorities.

SMOKING CESSATION:

All employees and members of the public who are interested in quitting smoking are urged to contact the California Smokers’ Helpline at 1-800-7NOBUTTS or call the American Lung Association Freedom From Smoking Program at 1-800-LUNGUSA.
